Terms and Conditions for Ecourses Nepal Pty Ltd
1. Introduction
Welcome to Ecourses Nepal Pty Ltd, a marketing platform dedicated to offering vouchers for online courses provided by local and overseas course providers ("Partners"). We facilitate the purchase of these vouchers, which can be used by our customers/students to enroll in courses on our Partners' websites. Please read these Terms and Conditions carefully before using our services.
By accessing or using Ecourses Nepal Pty Ltd ("Ecourses Nepal," "we," "us," or "our") and its website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.
2. Scope of Services
Ecourses Nepal operates as a marketing platform and intermediary between customers/students and our Partners. We sell vouchers that grant access to courses offered by our Partners on their respective websites. Ecourses Nepal does not deliver or administer the courses; this responsibility lies entirely with the Partners. We will, however, assist our customers/students in resolving issues they may encounter during the course enrollment process by liaising with our Partners.
3. Payment and Refunds
3.1 Payment: Payment for course vouchers must be made by our customers/students through a local third-party payment gateway company in Nepal, such as Esewa. Please refer to the Terms and Conditions of the respective payment gateway for any inquiries related to their policies and practices.
3.2 Refunds: All refund inquiries should be directed to Ecourses Nepal. Refunds will be handled on a case-by-case basis and evaluated on their merits. We will work closely with our Partners to ensure a fair resolution for our customers/students. Refund eligibility may vary depending on the policies of our Partners, and Ecourses Nepal will adhere to those policies.
4. Student Responsibilities
Customers/students using our services are responsible for complying with the terms and conditions of our Partners when enrolling in their courses. Any breach of these terms and conditions may result in the cancellation of the course enrollment.
5. Intellectual Property
All content on the Ecourses Nepal website, including text, images, graphics, logos, and course descriptions, is the intellectual property of Ecourses Nepal and/or our Partners. Users are prohibited from using, copying, or reproducing any of this content without explicit permission.
6. Privacy
Our privacy practices are outlined in our Privacy Policy. By using our services, you agree to the collection, use, and sharing of your information as described in the Privacy Policy.
7. Limitation of Liability
Ecourses Nepal is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services or the courses provided by our Partners. We are not responsible for the quality of the courses, the accuracy of course materials, or the conduct of our Partners.
8. Changes to Terms and Conditions
Ecourses Nepal reserves the right to update and modify these Terms and Conditions at any time. Any changes will be posted on our website, and the updated terms will be effective immediately.
9. TRANSFER OF PROPERTY RIGHTS UPON ORIGINAL USER'S PASSING
The ownership title of the courses held within the user's account (voucher code) will be transferred to the legal heir(s) in accordance with the laws of Nepal. However, such a claim must be submitted within a period of 5 years from the date of the user's demise. Ecourses Nepal Pty Ltd will process this request upon receipt of the necessary documentation proving the legal relationship.
In the event that the claim is not made within the specified timeframe mentioned above, the voucher codes will be made redundant by Ecourses Nepal Pty Ltd.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Ecourses Nepal Pty Ltd, its directors, advisors, officers, employees, affiliated partners, as well as content and service providers, from any and all claims, liabilities, damages, costs, expenses, and legal proceedings, including reasonable attorney's fees. These claims may arise from your use of the Electronic Channels or from the placement or transmission of any message, information, software, or other materials through the Electronic Channels by you or by users using your ID and password. This also includes any claims, disputes, or differences between you and any Supplier.
If a claim is brought against us related to your actions, content, or information on Ecourses Nepal Pty Ltd, you shall indemnify and hold us harmless from any damages, losses, and expenses of any nature (including reasonable legal fees and costs) associated with such claim. While we provide guidelines for user conduct, we do not have control over or direct users' actions on Ecourses Nepal Pty Ltd. We are not responsible for the content or information that users transmit or share on Ecourses Nepal Pty Ltd. Additionally, we are not liable for any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content or information that you may encounter on Ecourses Nepal Pty Ltd. We also do not assume responsibility for the conduct of users, whether online or offline, on our platform.
We strive to maintain the error-free and secure operation of Ecourses Nepal Pty Ltd, but you use it at your own risk. We provide Ecourses Nepal Pty Ltd on an "as is" basis without any express or implied warranties, including but not limited to implied warranties.
11. CLOSURE OF ACCOUNT
Customers who wish to close their Ecourses Nepal Pty Ltd account must submit a written application to Ecourses Nepal Pty Ltd or send an email to support@ecoursesnepal.com. Ecourses Nepal Pty Ltd will verify the application and proceed with the closure of the within 15 working days of receiving the application.
